Terms of Service

1. Eligibility & Age Verification

AI Dream Companion is an adult-oriented platform intended strictly for users who are 18 years of age or older (or the age of majority in your jurisdiction, whichever is greater). By creating an account or using the Service, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• Your use of the Service is lawful in your country, state, and locality.
• You will not allow any minor to access your account or any generated content.

We display an age-verification gate before allowing access to the Service. We reserve the right to suspend or terminate any account if we suspect the user is underage or misrepresenting their age.

2. Description of Service

AI Dream Companion provides AI-powered tools for generating fictional images, videos, and virtual companions ("Companions"). All content produced through the Service is computer-generated and synthetic; it does not depict real individuals, real events, or real-world likenesses unless you specifically upload reference material that you own or have rights to use.

3. Account Registration & Security

You agree to provide accurate information when registering and to keep your credentials confidential. You are solely responsible for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized access.

4. Subscriptions, Credits & Billing

Access to certain features requires a paid subscription or the purchase of credits. By subscribing or purchasing credits, you agree to:

• Pay all fees and applicable taxes associated with your purchase.
• Authorize us (and our payment processors) to charge your payment method on a recurring basis for subscriptions until you cancel.
• Acknowledge that subscription credits reset monthly and do not roll over, while purchased credit packs do not expire.
• Acknowledge that prices may change with notice; changes will not affect the current paid period.

All billing matters, including refunds, are governed by our Refund Policy, which is incorporated by reference.

5. Prohibited Content & Conduct

You agree NOT to use the Service to generate, upload, request, share, or distribute any content that:

• Depicts or appears to depict minors (anyone under 18) in any sexual or suggestive context, including subjects in diapers or school uniforms styled to suggest youth. This is strictly forbidden and will result in immediate account termination and reporting to authorities.
• Constitutes or facilitates the creation of deepfakes — AI-generated content that uses the likeness of a real person without their explicit, documented consent.
• Depicts non-consensual acts, including but not limited to sexual violence, sleeping/unconscious scenarios, or content depicting subjects under the influence of drugs, alcohol, or hypnosis.
• Depicts bestiality, animal cruelty, or sexual acts involving animals.
• Depicts incest or sexual scenarios involving family members (including step-family).
• Depicts violence, abductions, snuff, or fantasy snuff scenarios.
• Depicts watersports, scat, or similar fetish content prohibited by payment processors.
• Depicts prostitution, escorting, or sex trafficking scenarios.
• Facilitates, promotes, or depicts human trafficking of any kind.
• Uses the likeness of a real, identifiable individual without their explicit written consent (including celebrities, public figures, or private persons).
• Promotes hate speech, terrorism, self-harm, or discrimination.
• Provides professional advice (including medical, legal, or gambling/handicapping advice).
• Infringes any intellectual property rights, trademarks, or publicity rights.
• Promotes or depicts illegal activity of any kind.
• Contains malware, exploits, or attempts to disrupt the Service.
• Violates any applicable law, regulation, or card brand rules (including but not limited to Visa and MasterCard requirements for adult content merchants).

We employ automated content moderation systems and manual review. We reserve the right to remove content, suspend, or permanently terminate any account that violates these rules, without refund.

Cooperation with Law Enforcement & Human Trafficking. AI Dream Companion has zero tolerance for human trafficking, sex trafficking, and child sexual abuse material. We will fully cooperate with law enforcement and all relevant authorities in the investigation and prosecution of any suspected human trafficking, sex trafficking, or exploitation. We will promptly report any content or activity that we reasonably believe involves human trafficking or the exploitation of minors to the appropriate law enforcement agencies and, where applicable, to the National Center for Missing & Exploited Children (NCMEC), and we will preserve and disclose relevant account information, records, and evidence as required by law or valid legal process. Any account associated with such activity will be immediately and permanently terminated.

6. Content Screening & Moderation

AI Dream Companion implements multi-layered content screening to ensure compliance with our policies:

• Automated prompt moderation — All text prompts and generation requests are scanned in real-time for prohibited terms and categories before any content is generated.
• Character age enforcement — All AI characters on the platform must be at least 18 years old. Character creation with ages below 18 is blocked at the system level.
• AI-generated content labeling — All content produced on the platform is labeled as AI-generated.
• User reporting — Any user can report content they believe violates our policies via the in-app reporting tool or our Complaint & Takedown page.
• Admin review — Flagged content is reviewed by our compliance team, with a commitment to resolving complaints within 5 business days.

7. Face Reference & User-Uploaded Content (Content Provider Agreement)

By uploading any images, photographs, or reference materials (including for companion face reference or character training features), you enter into a Content Provider Agreement with AI Dream Companion. You represent and warrant that:

• You own the content or have all necessary rights, licenses, and consents to use it.
• The content does not depict any person under 18 years of age.
• You have explicit, documented consent from any identifiable person depicted to use their likeness in AI-generated content, including adult content.
• You affirm that any person depicted in your uploaded materials is at least 18 years of age.
• You are the sole party responsible for obtaining and maintaining all necessary consents and releases.
• You will indemnify AI Dream Companion against any claims arising from your failure to secure proper consent.

Uploading a real person's photo without their consent — including but not limited to ex-partners, classmates, coworkers, or celebrities — is strictly forbidden and may constitute a crime in your jurisdiction. Violations will result in immediate account termination.

8. AI Content Disclosure & Nature of Content

All visual content generated through the Service is 100% AI-generated and synthetic. No real individuals are depicted in generated content unless a user has uploaded their own face reference photo with proper documented consent. All AI-generated content on this platform is labeled as such. You acknowledge that:

• All content produced by the Service is computer-generated and does not depict real events or real people (unless user-uploaded face references are used with documented consent).
• You will not represent AI-generated content as depicting real people or real events.
• You will clearly label any AI-generated content as such when sharing outside the platform.
• The Service applies visible labels to generated content identifying it as AI-generated.

9. Ownership of Generated Content

Subject to your compliance with these Terms, you retain ownership of the content you generate using the Service. You may use generated content for personal and lawful commercial purposes. You grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, and display your generated content as necessary to operate, improve, and promote the Service. Public content may be displayed in our gallery and marketing materials unless you mark it private.

10. Intellectual Property

The Service, including all software, code, design, branding, models, and underlying technology, is owned by AI Dream Companion (Kimfortress, LLC) or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reverse-engineer, scrape, resell, or create derivative works of the Service itself.

11. Complaint, Takedown & Dispute Resolution Procedure

AI Dream Companion is committed to promptly addressing content complaints and removing infringing or prohibited material:

• How to file a complaint: Submit a complaint through our Complaint & Takedown page or email [email protected].
• Response time: All complaints are reviewed and resolved within five (5) business days. The resolution will be communicated to the complainant.
• Appeals: If you disagree with a resolution, you may appeal by contacting [email protected]. If there is a continued disagreement, we will submit the dispute to a neutral third party for resolution, with all associated costs covered by the merchant (Kimfortress, LLC).
• Content depicted persons: If you are depicted in any content on the platform and wish to have it removed, you may request removal at any time via the complaint procedure above. Your request will be honored promptly.

12. DMCA & Copyright Reports

If you believe content on the Service infringes your copyright or otherwise violates your rights (including unauthorized use of your likeness), please contact us at [email protected] with sufficient detail (URL, identification of the content, your contact info, and a statement of good faith). We will investigate and act promptly.

13. Affiliate Program

If you participate in our affiliate program, you agree to promote the Service in good faith, to not engage in spam or misleading advertising, and to comply with all applicable advertising and tax laws. Commissions are paid according to the terms displayed in your affiliate dashboard. We reserve the right to withhold or reverse commissions earned from fraudulent activity.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. AI MODELS MAY PRODUCE INACCURATE, OFFENSIVE, OR UNEXPECTED RESULTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI DREAM COMPANION (KIMFORTRESS, LLC) AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IN ANY MATTER SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless AI Dream Companion (Kimfortress, LLC), its officers, employees, and partners from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

17. Termination

We may suspend or terminate your account at any time, with or without notice, for any conduct that violates these Terms or that we deem harmful to other users, the Service, or our business. You may cancel your account at any time from your profile settings. Termination does not entitle you to a refund of any pre-paid amounts unless required by law or stated in our Refund Policy.

18. Compliance Reporting

AI Dream Companion maintains compliance with applicable payment card brand requirements for adult content merchants. We submit required compliance and violation reports to our payment processor(s) on a monthly basis, as required by card brand regulations.

19. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration or in the competent courts of Travis County, Texas. You waive any right to participate in class actions.

20. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or by posting a notice on the Service. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
